This does not exclude Our liability for mistakes due to negligence on Our part and refers only to variations of the correct Services, not different Services altogether. Please refer to sub-Clause 13.8 for incorrect Services. Further, it is understood that any details contained within any individual retreat, course, or experience landing page have been fully read, understood, and will be adhered to by the client.

12.2 Where appropriate, you may be required to select the required Plan of Services.

12.3 We neither represent nor warrant that such Services will be available at all times and cannot necessarily confirm availability until confirming your Order. Availability indications are not provided on the Website.

13. Orders and Provision of Services

13.1 No part of this Website constitutes a contractual offer capable of acceptance. Your order constitutes a contractual offer that We may accept at Our sole discretion. Only once we send you an order confirmation email will there be a binding contract between Bruce Taylor, Director, rootsoflife.org, and you.

13.2 Order confirmations under sub-Clause 13.1 will be sent to you before the Services begin and shall contain the following information:

13.2.1 Confirmation of the Services ordered, including full details of the main characteristics of those Services;

13.2.2 Fully itemized pricing for the Services ordered, including, where appropriate, taxes, delivery, and other additional charges;

13.4 Payment for the Services shall be taken via your chosen payment method immediately for any setup fee that corresponds to the service plan you purchased and on the same day of each subsequent month (“billing cycle”) for charges accrued during the previous month (“billing cycle”) and as indicated in the order confirmation you received.

13.5 We aim to fulfill your Order within 2-3 working days or, if not, within a reasonable period following your Order unless there are exceptional circumstances. If we cannot fulfill your Order within a reasonable period, we will inform you when you place the Order by a note on the relevant web page or by contacting you directly after you place your Order. Time is not of the essence of the Contract, which means we will aim to fulfill your Order within any agreed timescales, but this is not an essential term of the Contract, and we will not be liable to you if we do not do so. Suppose the Services are to begin within 14 calendar days of Our acceptance of your order at your express request. In that case, you must expressly acknowledge that your statutory cancellation rights, detailed below in Clause 14, will be affected.

We will ensure necessary corrections are made within five (5) working days. Additional terms and conditions may apply to the provision of certain Services. You’ll be asked to read and confirm your acceptance of any such terms and conditions when you complete your Order.

13.8 Bruce Taylor, Director, rootsoflife.org, provides technical support via email. Bruce Taylor, Director, rootsoflife.org, makes any effort possible to respond to support requests within two business days, but we do not guarantee a particular response time.

14. Cancellation of Orders and Services

We want you to be delighted with the Products or Services you order from rootsoflife.org. If you need to speak to us about your Order, contact us by email at grow@rootsoflife.org

14.1 If you are a consumer based within the European Union, you have a statutory right to a “cooling off” period. This period begins once your order is confirmed and the contract between Bruce Taylor, Director, rootsoflife.org, and you is formed. It ends 14 calendar days after that date. If you change your mind about the Services within this period and wish to cancel your order, please inform Us immediately using the following email: grow@rootsoflife.org. Your right to cancel during the cooling-off period is subject to the provisions of sub-Clause 14.2.

14.2 As specified in sub-Clause 14.1, you must make an express request to that effect if the Services are to begin within the cooling off period. By requesting that the Services begin within the 14 calendar day cooling off period, you acknowledge and agree to the following:

14.2.1 If the Services are entirely performed within the 14 calendar day cooling off period, you will lose your right to cancel after the Services are complete.

14.2.2 If you cancel the Services after provision has begun but is not yet complete, you will still be required to pay for the Services supplied up until the point at which you inform Us that you wish to cancel. The amount due shall be calculated in proportion to the total price of the Services and the actual Services already provided. Any sums already paid for the Services shall be refunded subject to deductions calculated by the preceding. Refunds, where applicable, will be issued within five working days and, in any event, no later than 14 calendar days after you inform Us that you wish to cancel.

14.3 Cancellation of Services after the 14 calendar day cooling off period (for EU customers) will not be eligible for a refund.

14.4 All purchases, courses, and deliverable material on the website are non-refundable upon purchase unless demanded by law in Hong Kong (SAR). Should you reside in a location whose laws supersede the laws of Hong Kong (SAR), the client will need to provide a clause and claim (supplied by the client to rootsoflife.org) for a refund. In no circumstances will any completed courses or offerings be applicable for a refund, and further, if the course is partially completed, the user will not be entitled to a refund unless specifically required by law in Hong Kong (SAR). By enrolling in, purchasing, subscribing to, or engaging in any monetary transaction within rootsoflife.org, you agree to these cancellation policies in full.

14.5 Cancellation policies MAY differ for retreats and organized courses; if this is the case, these policies will be displayed on the landing page for the particular course or event you are enrolling in. This will only apply to LIVE and in-person training and retreats and does NOT apply to LIVE but Virtual courses, training, retreats, and other options (i.e., mentorship, training, retreats, etc., held over distance through a provider such as Zoom or Skype). Any such Live but Virtual courses will be recorded. The recording will be provided to all participants, so it will not be possible to issue refunds if participation in the Live and Virtual event is impossible.

14.6 The client understands the above policies and further understands that Bruce Taylor, Director, rootsoflife.org, will make every effort to provide a satisfactory experience with the purchased product or offering via rootsoflife.org. Because of this, unless expressly stated by law that supersedes the laws of Hong Kong (SAR), the client agrees and understands that purchases from rootsoflife.org are assumed to be final, completed, and non-refundable upon purchase.

26.1 Mandatory Travel and Medical Insurance

26.1.1 The Participant is required to obtain and maintain comprehensive travel and medical insurance for the entire duration of the Pilgrimage, including coverage for: emergency medical treatment and hospitalization in Japan; medical evacuation and repatriation; trip cancellation and interruption; personal liability; and loss or damage to personal belongings.

26.1.2 Proof of adequate insurance coverage must be provided to the Organizer no later than 30 days prior to the Pilgrimage departure date. Failure to provide proof of insurance may result in the Participant being refused participation, with no refund of any payments made.

26.1.3 The Organizer accepts no liability whatsoever for any costs, losses, or damages arising from the Participant’s failure to obtain adequate insurance coverage. Any medical, evacuation, repatriation, or other emergency costs incurred during the Pilgrimage are the sole responsibility of the Participant.

26.2 Health Disclosure and Fitness to Participate

26.2.1 The Participant must disclose in writing to the Organizer, prior to enrollment, any physical or mental health conditions, disabilities, allergies, dietary requirements, or medications that may affect their ability to participate safely in the Pilgrimage activities.

26.2.3 The Organizer reserves the absolute right to refuse participation or to require a Participant to withdraw from any activity or the entire Pilgrimage if, in the Organizer’s sole judgment, the Participant’s health condition poses a risk to themselves or others. No refund will be provided in such circumstances.

26.2.4 Failure to disclose any relevant health information constitutes a material breach of these Terms and releases the Organizer from all liability arising from such non-disclosure.

26.3 Assumption of Risk

(a) Physical risks: hiking and walking on uneven, steep, or slippery terrain at Mt. Kurama and other sacred sites; exposure to varying weather conditions; physical exertion; falls, strains, sprains, or other injuries;

26.5 Indemnification

26.5.1 The Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, damages, liabilities, costs, and expenses (including legal fees) arising from or related to:

26.6.3 The Participant releases the Organizer from any liability arising from decisions made in good faith under this authorization.

26.7 Itinerary Changes and Cancellation

26.7.1 The Organizer reserves the absolute right to modify, alter, or cancel any aspect of the Pilgrimage itinerary at any time, including but not limited to: dates and times of activities; locations visited; accommodation arrangements; transportation arrangements; and participating teachers or guides.

26.8 Force Majeure

26.8.1 The Organizer shall not be liable for any failure or delay in performing obligations under these Terms, or for any loss or damage suffered by the Participant, arising from Force Majeure Events.

26.8.2 “Force Majeure Events” include but are not limited to: natural disasters (earthquakes, typhoons, tsunamis, volcanic eruptions, flooding); pandemics, epidemics, or disease outbreaks; war, terrorism, civil unrest, or political instability; government actions, travel restrictions, or border closures; airline or transportation failures, strikes, or cancellations; failure of third-party suppliers or service providers; and any other events beyond the reasonable control of the Organizer.

26.8.3 If the Pilgrimage is cancelled in whole or in part due to a Force Majeure Event:

(a) The Organizer may, at its sole discretion, offer the Participant a credit toward a future pilgrimage or alternative dates;

(b) The Organizer may retain deposits and payments to cover non-recoverable costs already incurred;

(c) The Participant shall not be entitled to any refund, compensation, or damages beyond what the Organizer, in its sole discretion, determines is reasonable and possible.

26.8.4 The Participant is strongly encouraged to obtain travel insurance that covers trip cancellation due to Force Majeure Events.
